National Intelligence Service (NIS) will have access to your private communication including mobile phone messages and emails should Statute Law Miscellaneous (Amendment) Bill 2014 go through.
The NIS which is headed by Michael Gichangi (pictured) seeks to have powers to tap into your private communication and is now seeking to have the removal of a requirement that they first get court warrants before trawling through your private messages.
It proposes the deletion of section 36 (2) of the current act, on limitation to right to privacy as enshrined in Article 31 of the Constitution, that provides for the court's participation.The court process was meant to mitigate between the need to protect the privacy of citizens while at the same time allowing government agents monitor the activities of those that they suspect of criminal involvement in activities such as terrorism, money laundering, drug trafficking and corruption.
It was upon the spy agency to convince the courts why it was important that the rights to privacy was removed but now this may not be the case soon, that is if the government gets its way in Parliament.
